You agree to purchase services and goods from mynewgazebo.co.uk subject to these Terms and Conditions which will apply to all transactions using mynewgazebo.co.uk

Your email address is essential in order for us to be able to supply you with important information such as Order Confirmations, and changes to the service.

Waiver

Whilst every effort has, is and will be taken to ensure that the information contained in this site is correct and up to date. The information may from time-to-time become incomplete, inaccurate or out of date. i.e small changes to the design or structure. To the full extent permitted by law, but subject to the terms and conditions of sale referred to below, we disclaim all warranties and representations (whether implied or expressed) as to the accuracy of any information contained on this Site

Definitions & interpretations

The price of the goods will be as quoted on the web site at the time you confirm your order subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order to add items, the prices charged will be those applicable to the new item(s) at the time that the amended order is confirmed. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.

The sale

An agreement for us to sell you Goods is made on these terms when we accept an order made by you via our website. The description of the Goods, the price, the VAT, insurance and delivery costs are set out in the order page. We will confirm acceptance of your order on-screen.

We aim to give you a clear idea of the nature of the products we sell. Illustrations, descriptions, and other information are approximate and for guidance only.

Details of the order

Quantity, quality and description of the Goods will be those set out in your order (if accepted by us)

Orders are accepted at our sole discretion but are normally accepted of the Goods are available, the order reflects current pricing, you are based in the Delivery area and your credit or debit card is authorized for transaction.

Price of the goods

Our charges for transport, packaging and insurance will all be included in the total for the Goods at the order confirmation page.

All prices quoted are British pounds (£) and include Value Added Tax (VAT)

Payment terms

Your credit/debit card account will be charged upon placing of your order. We do not accept liability if a delivery is delayed because you did not give us the right payment details.

We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from this website, unless this is solely due to our negligence.

Delivery

We will aim to deliver the Goods by the date quoted for delivery, but delivery periods are not guaranteed.

Once goods are delivered if the packaging or contents are believed to be damaged you must sign for the goods as “damaged” at the point of receiving said goods in order for us to process any claims derived from the condition of the goods received.

Once goods have been delivered you are required to check the entire gazebo and ensure all parts are present, we do offer a free spares service for damaged on arrival or missing parts, this applied to one delivery for any spares requested further spares will incur a charge.

We cannot confirm the exact delivery time, deliveries are typically made between 8:00 – 6:00. When your goods are delivered please ensure to check the condition of your purchase and sign if you are 100% satisfied. If your goods arrive damaged, then please make sure to note that when accepting the delivery and contact our sales office on 01384 637526 and we will make sure to resolve any disputes quickly and efficiently. You will be asked to email in some pictures of your gazebo so that we can resolve the problem as quick as possible.

If you are quite happy for the courier to leave your goods in a safe place if there is no one in to accept the delivery; please ensure these instructions are passed onto the sales office or by leaving a note on your order when placing.

All deliveries that are made without signature are done so at the risk of the buyer, we cannot process any claim with our delivery partners for damages without a signature on delivery.

It is the customers responsibility to be at the delivery address on the agreed date of delivery.

If you do not advise us that you will not be in and no alternative arrangements have been made, the goods will be left without signature in a safe place (we will not be held responsible for any damages in this instance) or returned to the local delivery depot for re-delivery. ANY RE-DELIVERY CHARGES WILL BE CHARGED TO THE CUSTOMER.

Risk and ownership

You will own the Goods once they have been successfully delivered and when we have received cleared payment in full. Once erected it is the purchasers responsibility to secure the gazebo in the recommend manner as laid out in our caring for your gazebo to ensure the gazebo is both safe and secure, the customer must also judge unsuitable weather conditions as described in caring for your gazebo where the canopy or curtains should be removed to prevent damage, any damage incurred due to adverse weather conditions or resulting from not securing the gazebo to a solid sound surface will not be the responsibility of the company.

On erecting any gazebo the area must be clear and flat in order to maintain the structure. any installation which dose not follow this may incur damage any claims for such damage will not be the responsibility of the company.

All our Gazebos are not designed for commercial applications.

Liability

 

These terms and conditions do not affect your statutory rights as a consumer.

Pictures on the website are generally accurate but variations in shape, size and colour must be expected.

Goods once delivered must be inspected by the customer to ensure the goods are in as new condition and are all present and correct and claims for missing parts or damage / manufacturing defects must be notified to us in writing within 28 days. Any damage caused by continued use with any of the above issues will invalidate any warranty.

Please note we do offer a 12 month limited warranty on the gazebo frame please note this is not transferable. The Canopy and Curtains carry a 30day warranty from receipt of goods

Warranty

All of our gazebo frames come with a 1 years limited warranty which covers the frames structure only subject to following all of the care instructions and care and liability conditions.

The gazebo canopies and curtains are covered by a 30 day manufactures guarantee against manufacture faults, our canopies if cared for (see caring for your gazebo)  should provide goods service, however the canopies and curtains are consumables which will from time to time require replacement. many factors with how the canopy and curtains are used and the conditions they are subjected to will vary the life span of the product.

We expect all our product to arrive with you in perfect condition if this is not the case please contact us immediately for us to help resolve any issue which may occur,
